Legal Governance of Technology Driven Cybercrime in Digital Society

This research examines the increasing use of technology across various sectors, which has contributed to the emergence of increasingly complex and difficult-tocontrol cybercrimes. Rapid advancements in information and communication technology have generated significant social and economic benefits while simultaneously creating new opportunities for cybercrime, including hacking, phishing, ransomware, digital fraud, identity theft, and the misuse of personal data. Indonesia provides an important case study because of its rapid digital transformation and growing cybersecurity governance challenges. This study analyzes the legal framework governing cybercrime in Indonesia and proposes a technolegal analytical framework integrating cyber law, regulatory adaptation, and digital governance to evaluate regulatory effectiveness. The research employs a normative juridical approach supported by a techno-legal analytical framework based on the examination of legislation, legal doctrines, official reports, and relevant scholarly literature. The findings indicate that although Indonesia has established legal instruments, particularly the Electronic Information and Transactions Law (UU ITE), significant implementation challenges remain, including limited law enforcement capacity, institutional coordination, resource constraints, digital evidence management, and relatively low public digital literacy. The analysis further demonstrates that technological development frequently outpaces regulatory adaptation, creating governance gaps that increase cybercrime risks and reduce regulatory effectiveness. This study contributes to cyber law and digital governance scholarship by integrating technological development, regulatory adaptation, and cybersecurity governance within a unified techno-legal analytical framework. The study concludes that strengthening adaptive legal regulations, enhancing institutional capacity, improving interinstitutional collaboration, and expanding digital literacy initiatives are essential for mitigating cybercrime and supporting a secure, sustainable, and inclusive digital ecosystem in Indonesia.
